Work Disputes | Dispute Resolution

01.08.2024LEADELL

Work disputes are a prevalent issue in both local and international labor markets. Our employment law specialists most frequently provide legal assistance in situations where the cause of the dispute is a breach of contract or workplace regulations, termination or dismissal of employment, or where disagreements often arise from discrimination, unequal treatment, or issues of equality. Regardless of how varied work disputes can be, the presence of an experienced specialist in all cases ensures the shortest path to resolution, either through agreement or, if necessary, through litigation. “It doesn’t matter whether the dispute is already in full swing or is still anticipated; a consultation with an experienced dispute resolver will save the employer time, money, and stress,” explains employment dispute expert Ilze Jankeviča.

Although no one is immune from work disputes, the frequency and complexity of such issues are significantly influenced by the corporate governance policies implemented within the company. If preventive measures have been taken to reduce a work environment that fosters misunderstandings, such as:

– professionally drafted and regularly integrated workplace regulations,

– adherence to gender equality principles (read more),

– development of accessible criteria for determining wages (read more), etc.,

disputes are likely to occur less frequently. It is also crucial to avoid errors in the implementation of legally mandated procedures. As employees become more knowledgeable about their rights, mistakes made by employers, such as those related to dismissal procedures, are not only noticed but also lead to significant compensation claims (read more). “In our daily work, we see how easily both small business owners and large, experienced companies can get lost in the maze of required documents and knowledge. We come to the rescue! We observe positive trends in the desire to implement sustainable corporate governance practices, but the missing element often tends to be systematicity and, yes, also a lack of knowledge,” shares leading partner and dispute resolution expert Kārlis Vītols.

The Role of a Specialist in Resolving Work Disputes

The presence of an employment dispute resolution expert reduces the tension and discomfort caused by escalating emotions that hinder progress toward the desired outcome. By providing appropriate legal assistance, including:

– consultations,

– opinions,

– document review and preparation,

– negotiation,

– client representation in court or other institutions, etc.,

the specialist helps the client resolve the dispute and avoid unnecessary risks that could escalate the situation.

How to Reduce the Risks of Work Disputes

  1. Evaluate the company’s internal procedures that regulate employment relations by engaging an employment law expert. If necessary, the specialist will improve, develop, and assist in implementing documents in daily work that promote the elimination of inequality, reduce the risks of misunderstandings, improve communication, and address tension caused by unclear interpretations of employer demands and employee performance.

  1. In a dispute situation, do not act intuitively—employment relations are strictly regulated, and it is very easy to make errors, including procedural ones, which can result in time and financial losses. Instead, consult with a field expert to undertake effective and correct actions towards resolution.

  1. Maintain regular communication with an employment law expert to stay informed about industry updates and best practices. As the labor market increasingly focuses on employee rights and well-being, not only is workplace regulation being improved and expanded, but employees are also becoming more knowledgeable and demanding.
