Employee Fabricates Mobbing Case | Employment

13.12.2024LEADELL

In the workplace, situations where employees use the concept of mobbing as a tool to achieve their desired results or even profit at the employer’s expense are becoming increasingly common. Such a case was recently observed in a company, where the analysis of the situation provides valuable lessons for both employers and employees.

Case Description

A new employee was hired by the company but unfortunately had to part ways during the probation period due to insufficient performance. Using their legal knowledge, the employee decided to take action against the company, claiming they were subjected to mobbing and that the termination of employment was unjustified.

Employee’s Unfair Actions

  • Filed a complaint with the State Labor Inspectorate
  • Made demands for reinstatement
  • Attempted to use the concept of mobbing as a tool to achieve their goals

Case Outcome

Thanks to the support provided by LEADELL Vītols labor law experts in investigating the case facts, gathering evidence, and preparing documentation, the State Labor Inspectorate concluded that no violations were found in the employer’s actions. As a result, the employee withdrew further claims against the employer.

“Collaboration with LEADELL Vītols attorney Māris Paipa was valuable—he effectively took initiative and managed the entire negotiation process with the State Labor Inspectorate,” comments the HR manager of the falsely accused employer.

Conclusions and Lessons

This case vividly illustrates that while mobbing is a serious problem in the workplace, there is also a risk that some employees may try to misuse this concept. This creates a need for employers to:

  • Carefully document all employee performance-related issues
  • Ensure clear and transparent employment relationships
  • Establish an effective internal communication system
  • Cooperate with labor law professionals

  • Ensure effective and objective complaint handling procedures in the company
  • Provide professional and transparent communication with employees
  • Conduct regular employee training on mobbing, its recognition, desired actions, and consequences of violations
  • Immediately engage professional legal support in problem situations

Importance of Legal Support

In this case, as in many others, professional legal support played a crucial role. The employer didn’t give in to provocation but sought help from LEADELL labor law experts. Expert involvement ensured:

  • Accurate legal assessment of the situation
  • Professional documentation preparation
  • Effective communication with the State Labor Inspectorate
