How to lodge creditor’s claim against ABLV Bank?

On 26 February 2018 the shareholders of ABLV Bank, AS took a decision about self-liquidation of the credit institution and the decision of the Financial and Capital Market Commission of 12 June 2018 allowed to implement the process of self-liquidation.

In case of liquidation of a credit institution, it is important for depositors and other creditors to regain their funds. In order to ensure the protection of such interests, the liquidator is imposed a statutory obligation to publish a notice about liquidation in the official edition “Latvijas Vēstnesis” and at least two other newspapers inviting creditors to file their claims and complaints.

The notice of liquidators of ABLV Bank, AS for creditors was published in the official edition on 18 June 2018. In the notice, creditors and other persons are invited to lodge their claims and other complaints within three months of the day of the publication, i.e. by 18 September 2018 (inclusive).

For any creditor of ABLV Bank, AS to lodge a claim, the creditor should prepare and submit to liquidators a statement of creditor’s claim, which includes creditor’s identification data, contact information, amount of the claim, creditor’s bank details to which the funds should be paid and information about the creditor’s representatives, if any. The application should be accompanied by documents certifying the creditor’s claim right against ABLV Bank, AS, as well as the right of representation of the creditor’s representative (if the claim is submitted by the representative). Moreover, according to the requirements set by the liquidators, if a creditor is represented by an authorised representative, when submitting a claim, his/her power of attorney should be notarised.

The creditor may fill the application in a free form or according to the form available on the website of ABLV Bank, AS www.ablv.com.

According to the information provided by liquidators of ABLV Bank, AS, creditors’ claims should be submitted in person to the office of ABLV Bank, AS at 23 Elizabetes Street, Riga. When submitting the claim, the creditor or its representative (if the claim is submitted by a representative) is identified and his/her signature on the creditor’s claim should be certified. If a creditor or its representative cannot certify his/her signature in person, then the signature should be certified by a notary.
